1. Introduction

SendWorks ("SendWorks," "we," "us," or "our") is the parent company behind a family of email marketing, deliverability, and communications products, including SendX and SendPost (together, the "Services"). This Privacy Policy applies across SendWorks and all of its Services, regardless of which product brand a customer or subscriber interacts with.

Where a specific Service has its own supplemental privacy terms (for example, product-specific data processing details), those terms supplement — but do not replace — this Policy.

SendWorks is operated by SendPost, LLC, a Delaware limited liability company doing business as SendWorks ("SendWorks," "we," "us," "our"), located at 1580 N. Logan Street, Suite 600, PMB 38591, Denver, Colorado 80203-1942. SendWorks acts as a data processor on behalf of its customers with respect to Subscriber data, and as a data controller with respect to Customer account data, as described below.

2. Definitions

"Controller" means an entity that determines the purposes and means of the Processing of Personal Data.
"Customer" means a person or entity registered to use the Services (e.g., a business sending email campaigns through SendX or SendPost).
"Data Protection Laws" means all applicable data protection and privacy laws, including the GDPR (EU/EEA, Switzerland, UK) and U.S. state privacy laws (e.g., CCPA/CPRA) where applicable.
"GDPR" means Regulation (EU) 2016/679.
"Personal Data" means any information relating to an identified or identifiable natural person.
"Processing" means any operation performed on Personal Data, whether automated or not (collection, storage, use, disclosure, deletion, etc.).
"Processor" means an entity that Processes Personal Data on behalf of a Controller.
"Services" means any SendWorks product, including SendX and SendPost, provided under SendWorks' Terms and Conditions.
"Subscriber" means an individual a Customer contacts through the Services (i.e., the Customer's own email recipients/contacts).

By accessing or using any SendWorks Service, you accept this Privacy Policy and our Terms and Conditions, and you consent to the collection, storage, use, and disclosure of your information as described here. This Policy applies to all visitors and users of SendWorks' websites and Services, whether or not you register for an account.

4. Information We Process

4.1 Personal Data

Customer information (i.e., businesses and individuals with a SendWorks/SendX/SendPost account):

Identification and contact data (name, email, username, phone)
Billing information (payment method details, billing address, account details)
Organization information (company name, address, geographic location, role, VAT/tax ID)
IP addresses and login/session data

Subscriber information (i.e., a Customer's own contacts, imported or collected through the Services):

Identification and contact data (name, email address, date of birth, gender, occupation, address, title)
Interests and preferences (purchase history, marketing preferences, publicly available social profile data)
IT information (IP address, usage data, cookie data, navigation data, location data, browser data)

You may log in at any time to view, update, or remove your Personal Data. Some data (e.g., email address) is mandatory to use certain Services — if you decline to provide it, we may not be able to deliver that Service.

4.2 Non-Personal Data

Browser/device information (device type, OS, browser, screen resolution, plug-ins, version of Services used)
Usage logs (time/date of access, browsing activity, referring/exit pages, click data)
Aggregated or de-identified data obtained from public databases, social platforms, third-party data providers, or marketing partners

5. How We Use Information

We use collected information to:

Operate, maintain, and improve the Services across the SendWorks portfolio (SendX, SendPost, and future products)
Provide customer support and respond to inquiries
Generate aggregate statistics and analytics on Service usage
Protect the rights, property, and safety of Customers, Subscribers, third parties, and SendWorks
Send informational, transactional, or (with consent, where required) promotional communications
Verify identity, manage billing and payments, and detect fraud
Comply with legal obligations and enforce our Terms and Conditions
Understand demographics and usage trends to develop new features and products

We may combine Personal Data with other information to personalize the Services or for advertising/targeting purposes, consistent with this Policy and applicable law.

6. How We Collect Information

Data provided by Customers: Customers may import Personal Data they have collected from their own Subscribers. SendWorks has no direct relationship with a Customer's Subscribers. Processing of Subscriber data is based on the Customer's own lawful basis (e.g., consent obtained by the Customer), and Customers are solely responsible for ensuring they have the necessary rights and permissions to have us Process that data on their behalf.

Tracking technologies, used across SendX, SendPost, and SendWorks properties:

Cookies — used to remember preferences and measure site usage. You can disable cookies in your browser, though some functionality may be affected.
Web beacons / tracking pixels — embedded in emails sent through the Services to measure opens, clicks, and campaign performance.
Other unique identifiers — used to administer the Services, analyze trends, and measure email/campaign performance.

Log data: IP address, browser type/version, pages visited, device identifiers (including mobile device ID and mobile OS, where applicable).

Third-party services: We may use services such as Google Analytics and Meta/Facebook to help us understand usage and, in some cases, to support advertising. These partners may use their own cookies or tracking technologies. You can review advertising opt-out options at http://www.aboutads.info/choices/.

7. Sharing of Information

We do not sell, rent, or lease Personal Data to third parties.

We may share information with:

Service providers who help us operate the Services (hosting, payment processing, analytics, customer support tooling, email/content delivery infrastructure)
Professional advisors, auditors, or successors in a merger, acquisition, or asset sale (see Section 13)
Law enforcement or regulators, where required by law, or to enforce our Terms and Conditions

Non-Personal Data may be shared or disclosed for any purpose, since it cannot reasonably be used to identify an individual.

8. Email Communications & Opting Out

We may send Service-related emails (account, billing, product updates) and, where you've opted in, promotional communications. Every marketing email includes an unsubscribe link. We may still send administrative, legal, or security-related messages necessary to operate the Services, even after you opt out of marketing emails.

If a Subscriber no longer wishes to be contacted by one of our Customers, they should unsubscribe directly via the link in that Customer's email or contact the Customer directly. SendWorks has no direct relationship with Subscribers and will refer any Subscriber inquiries back to the relevant Customer.

9. SMS Communications

Where you provide a mobile number and consent to SMS, we use SMS solely for customer-care purposes (e.g., onboarding assistance, account notifications, support communications) — not for marketing or promotions. Message frequency varies by account activity. Reply STOP to opt out or HELP for assistance. We do not share mobile information with third parties for marketing/promotional purposes.

10. Data Security

We maintain reasonable technical and organizational security measures appropriate to the risk, consistent with industry practice, to protect Personal Data against unauthorized access, disclosure, alteration, or destruction. No system is completely secure, and by using the Services you acknowledge and accept this inherent risk.

Customers are responsible for reviewing our published security practices and independently determining whether the Services meet their own regulatory and contractual obligations. Customers are also responsible for securing their own account credentials and for appropriately encrypting or backing up any Personal Data they upload to the Services.

11. Protecting Subscriber Lists and Data

We reserve the right to monitor Customer lists, content, and engagement/response data to confirm compliance with our Terms and Conditions and applicable anti-spam law (e.g., CAN-SPAM, CASL, GDPR). We will never share, sell, or rent Customer or Subscriber data to any third party for their own marketing purposes.

The Services may link to or integrate with third-party websites or applications. We are not responsible for the privacy practices of those third parties, and this Policy does not apply to information collected by them. We encourage you to review the privacy policies of any third-party site before using it.

13. Data Processing Agreement

For Customers subject to GDPR, CCPA, or similar frameworks, SendWorks maintains a Data Processing Agreement (DPA), incorporated by reference into our Master Subscription Agreement, covering our obligations as a Processor. We encourage all Customers to review and execute the DPA, available upon request at [legal@sendworks.com].

By using the Services, you represent that you are at least 18 years of age.

15. Merger, Acquisition, or Corporate Restructuring

If SendWorks (or any of its brands, including SendX or SendPost) is involved in a merger, acquisition, financing, or sale of assets, Personal Data may be transferred as part of that transaction. Any acquiring entity will remain bound to Process Personal Data consistent with this Policy, or will provide notice of any material change.

16. Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Services after changes are posted constitutes acceptance of the revised Policy. We encourage you to review this page periodically.

17. Your Rights

Depending on your location, you may have rights to access, correct, delete, restrict, or object to our Processing of your Personal Data, and to request a copy of the data we hold about you. We will respond to verified requests within the timeframe required by applicable law (e.g., within 30 days under GDPR).

Subscribers whose data is Processed on behalf of a Customer should generally direct such requests to that Customer directly, as SendWorks acts as a Processor for that data.
